By accessing or using this website and purchasing our services or digital products, you agree to be bound by the following Terms and Conditions. If you do not agree, please do not use our site or services.

1. Overview

These Terms and Conditions ("Terms") govern your use of the website and services provided by AR.CHETYPE DESIGN (referred to as "we", "us", or "our"). This includes our e-design packages, in-person consultations, and digital downloads.

We reserve the right to change these Terms at any time. The most recent version will always be available on our website.

2. Eligibility

To use our services, you must be:

  • At least 18 years old

  • Able to enter into a legally binding agreement

By using our site, you confirm that you meet these requirements.

3. Services Provided

We offer:

  • E-design packages (online interior design concepts and styling guidance)

  • In-person interior design consultations (location permitting)

  • Digital products (e.g. downloadable mood boards, specification sheets)

  • Styling advice and post-project support

The scope of each service will be clearly outlined before purchase or booking.

4. Booking and Payment

  • Full payment is required before any work commences.

  • Payment is accepted via CREDIT CARD, you will be sent to a secured payment platform.

  • All prices are in AUD and are not currently (2025) applicable to GST, unless stated otherwise.

  • Once a package or product is purchased, it is considered a confirmed agreement to the deliverables listed.

5. Digital Products and Downloads

  • All digital downloads (e.g. mood boards, design guides) are non-refundable due to their digital nature.

  • Files are for personal use only and may not be resold, redistributed or reproduced for commercial purposes; unless stated.

6. E-Design Service Limitations

E-design is a remote design service. It does not include:

  • On-site visits unless specifically arranged

  • Physical installation or coordination with trades

  • Custom furniture sourcing beyond what is outlined in the package

We aim to provide accurate recommendations, but product availability, pricing, and accuracy may change due to supplier or retailer changes.

7. Timeframes and Revisions

  • Timeframes for delivery will be communicated prior to the start of your project.

  • Revisions are limited to the number stated in your package (usually 1–2). Additional changes may incur further charges.

  • Delays in client communication or incomplete questionnaires may delay delivery times.

8. Refunds and Cancellations

Under the Australian Consumer Law, you are entitled to a refund or replacement if a service is not provided with due care and skill or as agreed.

However:

  • Change of mind refunds are not offered.

  • If you wish to cancel your service before work begins, please contact us within 24 hours of purchase.

  • Once design work has commenced, only partial refunds may be considered (case-by-case basis).

9. Client Responsibilities

You agree to:

  • Provide accurate and complete information (e.g. dimensions, photos, preferences)

  • Make timely communication throughout the design process

  • Take responsibility for checking dimensions, scale and fit before purchasing items from shopping lists

We are not liable for purchases made in error or items that do not fit your space if full and accurate information was not provided.

10. Intellectual Property

All design concepts, documents, mood boards, and digital products remain the intellectual property of [Your Business Name]. You are granted a non-transferable, single-use license for personal use only.

You may not copy, reproduce, modify, share, or resell any of our materials without our written consent.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special or consequential loss or damage.

  • We are not responsible for issues resulting from third-party suppliers, delivery delays, product defects, or installation problems.

Where liability cannot be excluded under Australian law, our liability is limited to re-supplying the service or refunding the service fee.

12. External Links and Suppliers

We may recommend products from third-party suppliers or retailers. We are not affiliated with (unless affiliate link) or responsible for these suppliers and make no guarantees regarding:

  • Product quality

  • Delivery or availability

  • Price accuracy or shipping policies

Please review the supplier’s terms before purchase.

13. Governing Law

These Terms are governed by the laws of Western Australia, Australia (or your state if you prefer). Any disputes will be subject to the jurisdiction of Australian courts.
